De onderstaande algemene voorwaarden, samen met eventuele beleidsregels waarnaar hierin wordt verwezen (deze “Servicevoorwaarden” of “Voorwaarden”) beschrijven uw rechten en verantwoordelijkheden wanneer u de Services gebruikt.

GEDEELTE 1 - TOEGANG EN ACCOUNT
Door akkoord te gaan met deze Servicevoorwaarden, verklaart u dat u ten minste meerderjarig bent in de staat of provincie waarin u woont, en hebt u ons toestemming gegeven om minderjarige van u afhankelijke personen de Services te laten gebruiken op apparaten die u bezit, koopt of beheert.
Om de Services te gebruiken, met inbegrip van het openen of doorbladeren van onze webshops of het aankopen van een van de volgende zaken
de producten of services die wij aanbieden, kan u gevraagd worden bepaalde informatie te verstrekken, zoals uw e-mailadres, facturering, bezorgadres en betaalgegevens. GEDEELTE 2 - ONZE PRODUCTEN
Wij hebben er alles aan gedaan om een nauwkeurige weergave van onze producten en services in onze webshops te geven. Houd er echter rekening mee dat kleuren of het uiterlijk van producten kunnen afwijken van hoe ze op uw scherm verschijnen, vanwege het type apparaat dat u gebruikt om toegang te krijgen tot de winkel en de instellingen en configuratie van uw apparaat.
Wij garanderen niet dat het uiterlijk of de kwaliteit van door u gekochte producten of services aan uw verwachtingen voldoen of hetzelfde zijn als afgebeeld of geleverd in onze webshops.
Alle productbeschrijvingen kunnen op elk moment zonder voorafgaande kennisgeving naar eigen goeddunken worden gewijzigd. Wij behouden ons het recht voor om op elk moment met een product te stoppen en kunnen de hoeveelheden van producten die wij aanbieden aan een persoon, geografische regio of rechtsgebied per geval beperken.
Gedeelte 3 - BESTELLINGEN
Wanneer u een bestelling plaatst, doet u een koopaanbod. Lommur.fashion behoudt zich het recht voor om uw bestelling om welke reden dan ook naar eigen goeddunken te accepteren of te weigeren. Uw bestelling is pas geaccepteerd nadat Lommur.fashion de acceptatie heeft bevestigd. Wij moeten uw betaling ontvangen en verwerken voordat uw bestelling wordt geaccepteerd. Controleer uw bestelling zorgvuldig voordat u deze verzendt, aangezien Lommur.fashion mogelijk geen annuleringsverzoeken kan verwerken nadat een bestelling is geaccepteerd. In het geval dat wij een bestelling niet accepteren, wijzigen of annuleren, zullen wij proberen u hiervan op de hoogte te stellen door contact op te nemen met het e-mailadres, factuuradres en/of telefoonnummer dat u bij het plaatsen van de bestelling hebt opgegeven.
Uw aankopen kunnen uitsluitend geretourneerd of omgeruild worden in overeenstemming met ons Terugbetalingsbeleid [LINK].
U verklaart en garandeert dat uw aankopen voor uw eigen persoonlijke of huishoudelijke gebruik zijn en niet voor commerciële wederverkoop of export.
GEDEELTE 4 - PRIJSSTELLING EN FACTURERING
Prijzen, kortingen en promoties kunnen zonder voorafgaande kennisgeving worden gewijzigd. De prijs die voor een product of service in rekening wordt gebracht, is de prijs die geldt op het moment dat de bestelling wordt geplaatst en wordt vermeld in de e-mail ter bevestiging van uw bestelling. Tenzij uitdrukkelijk anders vermeld, zijn de vermelde prijzen exclusief belastingen, verzend- en afhandelingskosten en douane- of invoerrechten.
De prijzen in onze webshops kunnen verschillen van de prijzen in fysieke winkels of in online winkels of andere winkels die door externe partijen worden beheerd. We kunnen van tijd tot tijd promoties aanbieden op de Services die de prijsstelling kunnen beïnvloeden en die onder algemene voorwaarden vallen die los staan van deze Voorwaarden. Als er een conflict is tussen de voorwaarden voor een promotie en deze Voorwaarden, gelden de voorwaarden voor de promotie.
U stemt ermee in om actuele, volledige en nauwkeurige aankoop-, betaal- en accountgegevens te verstrekken voor alle aankopen die u in onze winkels doet. U stemt ermee in om uw account en andere informatie, waaronder uw e-mailadres, creditcardnummers en vervaldata, prompt bij te werken, zodat wij uw transacties kunnen voltooien en indien nodig contact met u kunnen opnemen.
U verklaart en garandeert dat (i) de creditcardgegevens die u verstrekt waarheidsgetrouw, juist en volledig zijn, (ii) u naar behoren gemachtigd bent om een dergelijke creditcard voor de aankoop te gebruiken, (iii) door u gemaakte afschrijvingen door uw creditcardmaatschappij zullen worden gehonoreerd, en (iv) u door u gemaakte afschrijvingen zult betalen tegen de vermelde prijzen, inclusief verzend- en administratiekosten en alle van toepassing zijnde belastingen, indien van toepassing.
GEDEELTE 5 - VERZENDING EN BEZORGING
Wij zijn niet aansprakelijk voor vertragingen in verzending en bezorging. Alle levertijden zijn slechts schattingen en worden niet gegarandeerd. Wij zijn niet verantwoordelijk voor vertragingen die worden veroorzaakt door vervoerders, douaneafhandeling of gebeurtenissen waarover wij geen controle hebben. Zodra wij de producten aan de vervoerder overdragen, gaan de titel en het risico van verlies op u over.
GEDEELTE 6 - INTELLECTUEEL EIGENDOM
Onze Services, met inbegrip van maar niet beperkt tot alle handelsmerken, merken, tekst, displays, afbeeldingen, grafieken, productcontroles, video en audio, en het ontwerp, de selectie en de rangschikking daarvan, zijn eigendom van Lommur.fashion , zijn gelieerde ondernemingen of licentiegevers en worden beschermd door Amerikaanse en buitenlandse octrooi-, auteurs- en andere intellectuele eigendomswetten.
Deze Voorwaarden staan u toe de Services uitsluitend voor persoonlijk, niet-commercieel gebruik te gebruiken. U mag het materiaal op de Services niet reproduceren, distribueren, wijzigen, er afgeleide werken van aanmaken, in het openbaar vertonen, in het openbaar uitvoeren, opnieuw publiceren, downloaden, opslaan of verzenden zonder onze voorafgaande schriftelijke toestemming. Tenzij hierin uitdrukkelijk anders is bepaald, verleent niets in deze Voorwaarden u een licentie of andere rechten of zal niets worden uitgelegd als het verlenen van een licentie of andere rechten aan u onder enig octrooi, handelsmerk, auteursrecht of ander intellectueel eigendom van Lommur.fashion , Shopify of een externe partij. Ongeoorloofd gebruik van de Services kan een schending zijn van federale en staatswetten inzake intellectueel eigendom. Alle rechten die hierin niet uitdrukkelijk worden verleend, zijn voorbehouden aan Lommur.fashion .
De namen, logo's, product- en servicenamen, designs en slogans van Lommur.fashion zijn handelsmerken van Lommur.fashion of haar dochterondernemingen of licentieverleners. U mag dergelijke handelsmerken niet gebruiken zonder voorafgaande schriftelijke toestemming van Lommur.fashion . Shopify's naam, logo, product- en servicenamen, designs en slogans zijn handelsmerken van Shopify. Alle andere namen, logo's, product- en servicenamen, ontwerpen en slogans op de Services zijn handelsmerken van hun respectieve eigenaars.
GEDEELTE 7 - OPTIONELE TOOLS
U kunt toegang krijgen tot klantentools die door externe partijen worden aangeboden als onderdeel van de Services, waarover wij geen controle hebben, noch input.
U erkent en stemt ermee in dat wij toegang tot dergelijke hulpmiddelen bieden “zoals ze zijn” en “zoals ze beschikbaar zijn”, zonder garanties, verklaringen of voorwaarden van welke aard dan ook en zonder enige goedkeuring. Wij hebben geen enkele aansprakelijkheid die voortvloeit uit of verband houdt met uw gebruik van optionele tools van externe partijen.
Elk gebruik door u van de optionele hulpmiddelen die via de site worden aangeboden, is geheel op eigen risico en discretie en u dient ervoor te zorgen dat u bekend bent met en akkoord gaat met de voorwaarden waaronder hulpmiddelen door de relevante externe aanbieders worden aangeboden.
We kunnen in de toekomst ook nieuwe functies aanbieden via de Services (inclusief de release van nieuwe tools en hulpmiddelen). Dergelijke nieuwe functies worden ook geacht deel uit te maken van de Services en zijn onderworpen aan deze Servicevoorwaarden.
GEDEELTE 8 - LINKS VAN EXTERNE PARTIJEN
De Services kunnen materialen en hyperlinks bevatten naar websites die worden geleverd of beheerd door externe partijen (inclusief ingesloten functionaliteit van derden). Wij zijn niet verantwoordelijk voor het onderzoeken of evalueren van de content of nauwkeurigheid van materialen of websites van externe partijen waartoe u toegang kiest. Als u besluit de Services te verlaten om toegang te krijgen tot deze materialen of sites van externe partijen, doet u dit op eigen risico.
Wij zijn niet aansprakelijk voor schade of schade in verband met uw toegang tot websites van externe partijen, of uw aankoop of gebruik van producten, services, bronnen of content op websites van externe partijen. Controleer zorgvuldig het beleid en de praktijken van de externe partij en zorg ervoor dat u deze begrijpt voordat u een transactie aangaat. Klachten, claims, zorgen of vragen over producten en services van externe partijen moeten worden gericht aan de externe partij.
GEDEELTE 9 - RELATIE MET SHOPIFY

Lommur.fashion is powered by Shopify, wat ons in staat stelt de Services aan u te leveren. Alle verkopen en aankopen die u in onze Winkel doet, worden echter rechtstreeks met Lommur.fashion gedaan. Door het gebruik van de Diensten, erkent u en gaat u ermee akkoord dat Shopify niet verantwoordelijk is voor enig aspect van een verkoop tussen u en Lommur.fashion , met inbegrip van letsel, schade of verlies als gevolg van gekochte producten en services. Hierbij ontslaat u Shopify en haar affiliates uitdrukkelijk van alle claims, schade en aansprakelijkheden die voortvloeien uit of verband houden met uw aankopen en transacties met Lommur.fashion .
GEDEELTE 10 - PRIVACYBELEID
Alle persoonlijke informatie die we verzamelen via de Services is onderworpen aan ons Privacybeleid, dat u hier kunt bekijken [LINK], en bepaalde persoonlijke informatie kan onderworpen zijn aan het Privacybeleid van Shopify, dat u hier kunt bekijken hier. Door de Services te gebruiken, erkent u dat u dit privacybeleid hebt gelezen.
Omdat de Services worden gehost door Shopify, verzamelt en verwerkt Shopify persoonlijke informatie over uw toegang tot en gebruik van de Services om de Services voor u te kunnen leveren en verbeteren. Informatie die u indient bij de Services zal worden verzonden naar en gedeeld met Shopify en externe partijen die zich in andere landen kunnen bevinden dan waar u woont, om services aan u te kunnen leveren. GEDEELTE 11 - FEEDBACK
Als u ideeën, suggesties, feedback, beoordelingen, voorstellen, abonnementen of andere content (gezamenlijk “Feedback” genoemd) indient, uploadt, plaatst, e-mailt of anderszins verzendt, verleent u ons een eeuwigdurende, wereldwijde, sublicentieerbare, royaltyvrije licentie om dergelijke Feedback te gebruiken, te reproduceren, te wijzigen, te publiceren, te distribueren en weer te geven in welk medium dan ook voor welk doel dan ook, inclusief voor commercieel gebruik. Wij kunnen onze rechten onder deze licentie bijvoorbeeld gebruiken om de Services te exploiteren, te leveren, te evalueren, te verbeteren en te promoten en om onze verplichtingen na te komen en onze rechten uit te oefenen onder de Servicevoorwaarden.
U verklaart en garandeert tevens dat: (i) u de eigenaar bent van of alle benodigde rechten hebt op alle Feedback; (ii) u eventuele compensatie of incentives die u hebt ontvangen in verband met uw Feedback bekend hebt gemaakt; en (iii) uw Feedback voldoet aan deze Voorwaarden. Wij zijn niet verplicht (1) om uw Feedback vertrouwelijk te behandelen; (2) om een vergoeding te betalen voor uw Feedback; of (3) om op uw Feedback te reageren.
Wij kunnen feedback controleren, bewerken of verwijderen waarvan wij naar eigen goeddunken bepalen dat deze onwettig, beledigend, bedreigend, lasterlijk, pornografisch, obsceen of anderszins verwerpelijk is of het intellectuele eigendom van een partij of deze Servicevoorwaarden schendt, maar zijn hiertoe niet verplicht.
U stemt ermee in dat uw Feedback geen inbreuk maakt op enig recht van een externe partij, met inbegrip van auteursrecht, handelsmerk, privacy, persoonlijkheidsrechten of andere persoonlijke of eigendomsrechten. U stemt er verder mee in dat uw Feedback geen lasterlijke of anderszins onwettige, beledigende of obscene Feedback bevat, of een computervirus of andere malware bevat die op enigerlei wijze de werking van de Services of een gerelateerde website kan beïnvloeden. U mag geen vals e-mailadres gebruiken, zich niet voordoen als iemand anders dan uzelf of ons of externe partijen anderszins misleiden wat betreft de oorsprong van feedback. U bent als enige verantwoordelijk voor alle feedback die u geeft en de nauwkeurigheid ervan. Wij nemen geen verantwoordelijkheid en aanvaarden geen aansprakelijkheid voor feedback die door u of een externe partij is geplaatst.
GEDEELTE 12 - FOUTEN, ONNAUWKEURIGHEDEN EN WEGLATINGEN
Af en toe kan er op of in de Services informatie staan die typografische fouten, onnauwkeurigheden of weglatingen bevat die betrekking kunnen hebben op productbeschrijvingen, prijsstelling, promoties, aanbiedingen, prijsstelling voor verzending van producten, transittijden en beschikbaarheid. Wij behouden ons het recht voor om eventuele fouten, onnauwkeurigheden of weglatingen te corrigeren, en om informatie te wijzigen of bij te werken of bestellingen te annuleren als de informatie onjuist is op elk gewenst moment zonder voorafgaande kennisgeving (inclusief nadat u uw bestelling hebt ingediend).
GEDEELTE 13 - VERBODEN GEBRUIK
U mag de Services alleen voor wettige doeleinden bezoeken en gebruiken. Het is u niet toegestaan de Services direct of indirect te openen of te gebruiken (a) voor onwettige of kwaadwillige doeleinden; (b) om internationale, federale, provinciale of staatsverordeningen, regels, wetten of plaatselijke verordeningen te overtreden; (c) om inbreuk te maken op onze intellectuele eigendomsrechten of de intellectuele eigendomsrechten van anderen of deze te schenden; (d) onze werknemers of andere personen lastig te vallen, te misbruiken, te beledigen, te schaden, te belasteren, te belasteren, te intimideren of schade toe te brengen; (e) onjuiste of misleidende informatie te verzenden; (f) materiaal te verzenden, bewust te ontvangen, te uploaden, te downloaden, te gebruiken of te hergebruiken dat niet in overeenstemming is met deze Voorwaarden; (g) reclame- of promotiemateriaal te verzenden of te laten verzenden, waaronder “junkmail”, ‘kettingbrieven’, “spam” of andere soortgelijke verzoeken; (h) zich uit te geven voor of te proberen zich uit te geven voor een andere persoon of entiteit; of (i) deel te nemen aan enig ander gedrag dat iemands gebruik of plezier van de Services beperkt of belemmert, of dat, zoals door ons bepaald, schade kan toebrengen aan Lommur.fashion , Shopify of gebruikers van de Services, of hen kan blootstellen aan aansprakelijkheid.
Bovendien stemt u ermee in om niet: (a) virussen of andere kwaadaardige codes te uploaden of over te brengen die op enige wijze de functionaliteit of werking van de services zullen of kunnen beïnvloeden; (b) enig deel van de services te reproduceren, dupliceren, kopiëren, extraheren, verkopen, doorverkopen of exploiteren; (c) de persoonlijke informatie van anderen te verzamelen of te traceren; (d) de services te spammen, phishen, pharmen of pretenderen; (e) robots, spiders, schraap-, dataverzamel- en extractietools, automatische apparaten of processen, AI-tools (zoals agentic AI) of geautomatiseerde of handmatige middelen te gebruiken om toegang te krijgen tot de Services; of (f) de beveiligings- of autorisatiefuncties, robotuitsluitingsheaders of andere maatregelen die wij gebruiken om de toegang tot de Services te beperken, te verstoren, te omzeilen of te omzeilen. Wij behouden ons het recht voor om uw account op elk moment en zonder voorafgaande kennisgeving op te schorten, uit te schakelen of te beëindigen als wij vaststellen dat u een deel van deze Voorwaarden hebt geschonden.
GEDEELTE 14 - AGENTS
14.1 Dit gedeelte (“Agent voorwaarden”) is van toepassing als u een Agent gebruikt, toestaat, in staat stelt of laat gebruiken voor toegang tot, gebruik van of interactie met Services. “Agent” betekent elke software of dienst die autonoom of semi-autonoom actie onderneemt namens of in opdracht van personen of entiteit en die namens of met behulp van het apparaat van een persoon kan worden uitgevoerd zonder direct toezicht.
14.2 Een Agent mag geen toegang hebben tot, gebruik maken van of communiceren met Services tenzij hij zichzelf te allen tijde identificeert en handelt in strikte overeenstemming met de vereisten in gedeelte 14.4 hieronder. Bovendien mag een Agent geen toegang hebben tot, gebruik maken van of communiceren met Services als wij de Agent hebben verzocht zich te onthouden van toegang tot, gebruik van of interactie met enige service.
14.3 Wij kunnen beperken, inclusief door technische maatregelen, of en hoe een Agent toegang krijgt tot, gebruik maakt van en interageert met Services.
14.4 Agents moeten: (i) in alle HTTP/HTTPS-verzoeken aangeven dat het verzoek afkomstig is van een Agent en de naam van de Agent bekendmaken door het volgende op te nemen in de gebruiker-agent string van het verzoek: “Agent/[naam agent]”; (ii) niet verhullen of verdoezelen dat toegang, gebruik of interacties afkomstig zijn van een Agent, zoals door (a) het nabootsen van menselijk gedrag en interactiepatronen, of (b) het invullen of omzeilen van CAPTCHA's of maatregelen die bedoeld zijn om computergebruik te onderscheiden van mensen, (iii) naar waarheid antwoorden op vragen of prompts die bedoeld zijn om te bepalen of interacties afkomstig zijn van een mens of een computer, (iv) geen maatregelen omzeilen of anderszins vermijden die bedoeld zijn om te blokkeren, beperken, wijzigen of controleren of en hoe Agenten toegang krijgen tot, gebruik maken van of communiceren met de Services.
GEDEELTE 15 - BEËINDIGING
Wij kunnen deze overeenkomst of uw toegang tot de Services (of een deel daarvan) te allen tijde naar eigen goeddunken en zonder voorafgaande kennisgeving beëindigen, en u blijft aansprakelijk voor alle verschuldigde bedragen tot en met de datum van beëindiging.
De volgende gedeelten blijven van toepassing na beëindiging: Intellectueel eigendom, Feedback, Beëindiging, Disclaimer van Garanties, Beperking van aansprakelijkheid, Schadeloosstelling, Scheidbaarheid, Verklaring van afstand; Volledige overeenkomst, Overdracht, Toepasselijk recht, Privacybeleid en andere bepalingen die door hun aard na beëindiging van kracht moeten blijven.
GEDEELTE 16 - AFWIJZING VAN GARANTIES
De informatie die op of via de Services wordt gepresenteerd, wordt uitsluitend ter beschikking gesteld voor algemene informatiedoeleinden. Wij staan niet in voor de nauwkeurigheid, volledigheid of bruikbaarheid van deze informatie. Elk vertrouwen dat u in dergelijke informatie stelt, is strikt op eigen risico. TENZIJ UITDRUKKELIJK VERMELD DOOR [MERCHANT], WORDEN DE SERVICES EN ALLE PRODUCTEN DIE VIA DE SERVICES WORDEN AANGEBODEN ‘AS IS’ EN ‘AS AVAILABLE’ VOOR UW GEBRUIK GELEVERD, ZONDER ENIGE VERTEGENWOORDIGING, GARANTIES OF VOORWAARDEN VAN WELKE AARD DAN OOK, HETZIJ UITDRUKKELIJK HETZIJ IMPLICIET, MET INBEGRIP VAN ALLE IMPLICIETE GARANTIES OF VOORWAARDEN VAN VERKOOPBAARHEID, VERKOOPBARE KWALITEIT, GESCHIKTHEID VOOR EEN BEPAALD DOEL, DUURZAAMHEID, TITEL EN NIET-INBREUK. WIJ GARANDEREN NIET DAT UW GEBRUIK VAN DE SERVICES ONONDERBROKEN, TIJDIG, VEILIG OF VRIJ VAN FOUTEN ZAL ZIJN. IN SOMMIGE RECHTSGEBIEDEN IS DE AFWIJZING VAN IMPLICIETE OF ANDERE GARANTIES BEPERKT OF NIET TOEGESTAAN, ZODAT DE BOVENSTAANDE AFWIJZING VAN AANSPRAKELIJKHEID MOGELIJK NIET OP U VAN TOEPASSING IS.

GEDEELTE 18 - VRIJWARING
U gaat ermee akkoord Lommur.fashion , Shopify, en onze filialen, partners, functionarissen, directeuren, werknemers, agenten, aannemers, licentieverleners en serviceproviders te vrijwaren, verdedigen en schadeloos te stellen van alle verliezen, schade, aansprakelijkheden of claims, met inbegrip van redelijke honoraria van advocaten, te betalen aan derden als gevolg van of voortvloeiend uit (1) uw schending van deze Servicevoorwaarden of de documenten waarnaar verwezen wordt, (2) uw schending van een wet of de rechten van een externe partij, of (3) uw toegang tot en gebruik van de Services.

Article 13 – Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 working days after the start of the cooling-off period referred to in Article 6(1). The consumer is obliged to promptly notify the entrepreneur of any inaccuracies in the provided or stated payment details. A complaint does not suspend the obligations of the entrepreneur, unless the entrepreneur indicates otherwise in writing. If a complaint is found to be justified by the entrepreneur, the entrepreneur will, at their discretion, either replace or repair the delivered products free of charge.

Article 15 – Disputes
Dutch law exclusively applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply, even if the consumer resides abroad.
